Biography
Ethan Klein (born 1985 in Ventura, California) built h3h3Productions with his wife Hila from reaction-video satire into the H3 Podcast, one of YouTube’s defining talk shows. He has history with internet copyright law: the Kleins’ 2017 victory in Klein v. Hosseinzadeh was a landmark fair-use win for commentary channels — which makes his current position, suing AI companies over what they call fair use, a pointed role reversal.
Taking the scrapers to court
In April 2026, the Kleins’ channels joined class-action lawsuits in California federal court accusing Apple — and in parallel filings Meta, Nvidia, ByteDance, Snap, and others — of deliberately circumventing YouTube’s anti-scraping protections (rotating IP addresses, bulk video extraction) to harvest creators’ videos as AI training data. The complaint calls it “an unconscionable attack” on creators; Apple counters that publicly available videos were fair game. Announcing the suits on the podcast with his lawyer AttorneyTom, Klein framed the stakes as existential for his profession, noting the rise of AI influencers already competing for attention.
Klein’s anti-AI record predates the lawsuits. During the January 2023 Atrioc scandal — a streamer caught browsing deepfake pornography of colleagues including QTCinderella — Klein condemned the deepfake industry, though he badly stumbled first: he laughed on air during QTCinderella’s tearful response, apologized in a video titled “What is wrong with me?”, and later blasted Ludwig as a hypocrite for continuing to work with Atrioc.
The through-line is a creator-labor stance: Klein is not warning about superintelligence — he is arguing that trillion-dollar companies took the creative output of millions of people without permission or payment, and should answer for it in court.
